Real Estate Firm

About

A Real Estate Firm is required to be licensed by the Tennessee Real Estate Commission, have a principal broker and maintain a fixed location and adequate facilities for affiliated licensees, located to conform with zoning laws and ordinances.

The license of a broker and of each affiliate broker under contract to the broker shall be prominently displayed in the broker's principal place of business.

Each licensed broker shall maintain a sign on the outside of the broker's office of the size and content that local ordinances and the Commission prescribe, which shall clearly state that the broker is engaged in the real estate business.

 

Requirements

  • Submit a completed notarized application with fee;
  • Obtain and submit a current zoning letter from proper governmental authorities; if local jurisdiction does not have zoning regulations, submit a letter from local county or city mayor that jurisdiction does not have zoning regulation;
  • Submit appropriate TREC 1 paperwork and fees for licensed Tennessee broker to become principal broker or for an existing principal broker to transfer into the firm;
  • If corporation or limited liability company, submit a current copy of the firm’s certification (or Letter of Good Standing) from Tennessee Secretary of State, along with any d/b/a name;
  • All individual licensees must carry Errors and Omissions Insurance;
  • Open and provide proof of escrow account and supply name and address of bank, name of account, account number and have principal broker sign; if firm will not hold money belonging to third parties, then a waiver of escrow should be completed and approved by the Commission.
  • Supply copies and explanations for any bankruptcies and/or complaints, civil judgments or attachments; and
  • If Non Resident firm, complete, sign and have notarized Consent to Jurisdiction and Consent to Suits.

Fees

Application Fee:  $90

Renewal Fee:  $75 (biennial)

Additional

Persons engaged in Property Management need an active Tennessee broker or affiliate broker real estate license and must be affiliated with a firm actively licensed in TN.

Firms are required to keep records of all real estate transactions for a period of three years. These files must contain, at a minimum, the following:

  • Listings
  • Offers (Even offers that did not become contracts)
  • Contracts
  • Closing Statements
  • Agency Agreements
  • Agency Disclosure Documents
  • Property Disclosure Forms
  • Correspondence
  • Notes and any other Relevant Information

If not renewed within 60 days after expiration, must reapply for license.

Change of address

In order to change your real estate firm address, you will need to log in or create an account at https://core.tn.gov. After you log in or create an account, you will choose the “My Licenses or Permits” tab, select the credential you need to update, then select the Address Change option. Here you will be able to enter your new firm address and upload the required zoning letter. You may also mail in the Firm Updates Form (TREC2) along with the required zoning letter for processing. There is not fee associated with changing your firm address.
