About
Any person conducting the business of a livestock market must obtain a Livestock Market License from the Tennessee Department of Agriculture. "Livestock Market" is defined as any location where livestock is assembled and sold at public auction, on a commission basis, or otherwise for the compensation of the owner or operator, during regularly scheduled or special sales. "Livestock" means cattle, calves, horses, mules, poultry, swine, sheep, goats, and alternative livestock. "Alternative Livestock" means non-traditional livestock that are hoofed and captive-farmed for purposes of agricultural or recreational use.
Requirements
The following items are required in order to obtain a Livestock Market License: 1) Proof of property and fire insurance; 2) Proof of bond with USDA, Packers and Stockyards (or other surety instrument registered with USDA, Packers and Stockyards); 3) Completed application and $100 application fee.
Fees
Livestock Market License fee is $100.00 annually. License year runs from July 1 through June 30.
Additional
Livestock market operators are required to keep the following records for each lot of livestock consigned to or sold through such livestock market:
1) The name and address of the consignor;
2) A description of the livestock which shall include ear tag number or back tag number, or animal descriptors such as livestock sex, color, marking, or weight;
3) The date the livestock was received and sold;
4) The name and address of the purchaser of the livestock; and
5) The price for which the livestock was sold or exchanged and the commission or other fees charged by the livestock market, including such inspection fees as are required.
Sale records shall be open for inspection by all officers or inspectors charged with the enforcement of the law, and they shall be preserved and retained for a period of at least two (2) years.
It is unlawful to sell, or offer to sell, to buy, or offer to buy, livestock within two thousand (2,000) feet of a licensed livestock market property.
